  1. We guarantee delivery on date but, even though we try our level best to deliver on time, we cannot guarantee delivery on any particular time. Although we try to deliver around the mentioned delivery time as instructed and process the order for delivery as far as possible to deliver on or before the particular time mentioned, but we do not guarantee that. Some Gift items like Leather Bags, Toys, Watches, Apparels etc are essentially delivered through courier and are dispatched from our end well in time. We are responsible for delay in dispatch from our warehouse and will not be responsible for delay at the logistic partners end.
  2. We shall dispatch all non tracking rakhi orders from our end. Since, these are non tracking orders, we shall not be liable to track it's delivery and will not entertain any complaint for non delivery in these orders. Customers are requested to connect with their recipients for delivery confirmation. They may ask the recipients to visit the local post office and check in their designated post box and drop box. They are also required to check the parcel at their community drop box.
  3. Images of flowers and cakes shown here are indicative and though we thrive to deliver similar or higher quality products, it may be possible that actual arrangement may vary a bit due to unavailability of flowers or other reasons beyond our control. Also, based on availability of stock, the items or models of some items like flowers, cakes, sweets, cycles, plants, planters, refrigerators etc. may also vary. In such cases, we reserve the right to provide alternate item or model albeit ensuring products of similar or higher value to customers.
  4. Bakeries for Fresh Baked Cakes open at around 10:30 am and hence deliveries for the same shall happen after that time. In exceptional cases, on customers request, we may buy the cake a day prior to delivery and keep it in refrigerator for early delivery but we would not advise this.
  5. Depending on the delivery destination, the delivery schedule may vary from same day delivery to delivery within the next 1 to 3 business days, excluding the date of order. Holidays may extend it further.

  7. Our cut-off time for same day delivery including midnight orders is 4pm IST. Though we try to deliver orders for same day received after the cut-off time same day itself, else they shall be processed as next day delivery/ dispatch orders. Also, in case an urgent order for some day is placed post cut-off time, give us a phone call to try and process it the same day.
  8. The delivery charges within the city are free. However, for some off locations which are out of city limits or for some remote location in town or villages, we may send a link to you for payment of this extra delivery charge, if required. Your order will be on hold till we receive any update from you and if we do not hear from you in 5 days - we will cancel your order and refund the amount and inform the same to you via email.
  9. We reserve the right to reschedule the delivery to an earlier or later date in case of floods, Heavy Rains/ Bandh / Strike / Lockdown / Covid19 Precautions & Restrictions or any other such reasons beyond our control.
  10. In case no delivery date is mentioned with the order, we may assume it to be for sameday and shall process and dispatch the order within 24 hrs.
  11. If a customer wants to cancel an already placed order, he may choose to do so at least 24 hrs before the delivery/ dispatch date. In all such cases, we shall cancel the order after deducting 7% of the ordered amount towards credit card processing expenses.Also, order modification, if any, can be done only 1 day prior to date of delivery, between 8 am to 8 pm.
  12. In case of any complaint or dissatisfaction against the quality of product delivered the customer or the recipient is required to get in touch within 48 hrs with an image of the product delivered justifying the complaint. Based on the same, we may Refund or Redeliver the order but any refund or redelivery will be based on the sole discretion if the website. We shall not be liable for no claim amount of any nature more than the full value of the ordered amount under any circumstances.
  13. In case the receiver or any representative is not available at the time of delivery, we shall take the order as delivered. However we always try to take an appointment over phone before delivery.
  14. For any hand delivered perishable item like flowers or cakes we may call up the recipient to take appointment for delivery or in exceptional cases, to ask for locations landmarks to carry out the delivery. However, in case, the recipient or any of his representative is not there to collect at the time of delivery, we shall treat the order as delivered. Also, in case due to some personal reason a recipient refuses to accept the delivery, we shall regard the order as delivered and no refund shall be processed for the same. For any order in which problem arises due to the mistake of the user e.g. wrong address or incomplete information or recipient not reachable, no refund will be given.
  15. Gifts-to-India.com reserves the right to refuse delivery of any order unconditionally without assigning any reason whatsoever to the customer. However, in all such cases Gifts-to-India.com will refund the amount paid by customer in full.
  16. The web prices of the products which are having MRP, includes costs of our services, delivery and online transactions cost and due to technical restrictions are not shown separately.
  17. The responsibility of the quality of product shall be with the respective brand owners. In case of any quality related issue with the products delivered to you, you may lodge complaints on them through us.
  18. We are selling only non-alcoholic wines, champagnes and sparkling wines in our website.
  19. The various logos/Trademark backed by product being sold by us on the website belong to respective companies and they are the owner of said Logo/Trademark.
  20. Our merchant HDFC bank shall be under no circumstances be liable for any loss or damage arising directly of indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
  21. In case for a served(processed/delivered) order against which we have not received the money, due to any reason what so ever it is, the Customer & the Recipient shall be equally liable to compensate for the sum due. In case both the Customer & the Recipient refuses to pay us, we shall take appropriate legal steps to realize the sum due. In case any Octroi or similar Charges is levied by the state of the recipient, it has to be borne by the consignee.
  22. For any international delivery sent through courier, any charges levied by the customs department of recipient's country like Customs Duty, VAT or Octroi; will have to be borne by the Customer/Recipient and we shall not be liable for the same. In case the customer/recipient refuses to pay this amount at the time of clearance/delivery of the parcel, the order will be considered as delivered and will not be liable for any refund.
  23. If we are unable to deliver your order, then complete refund will be made. We shall not be liable for any other charges, loss of profits, emotional stress or any other liability etc. caused due to non-delivery.
  24. All claims/ issues are subject to the jurisdiction of local Court only in Kolkata, India.
  25. For deliveries at Hostel, Hotels & Hospitals address, POD signed at the reception or by security personnel will be a valid proof of delivery. Though we try to get the sign of the actually intended recipient but at these places, due to reasons beyond our control, we cannot assure it. If the delivery boy is stopped at the premise gate of any of these locations we try to get in touch with the recipient. If for any reason the phone goes unanswered we consider it as an attempted delivery.
  26. All Rakhi orders will be delivered at the earliest irrespective of delivery date chosen.
  27. We are despatching all consignements as per your orders & we shall not be responsible for any clearance at respective Countries Customs Counter. It has to be done at you end.
  28. "By accepting our T&C, you also accept to receive all our communication matters, notification, newsletters, promotional matters etc. through various media channels". However, we confirm that we do not give any customer data to any agency outside the group.
  29. No refund can be made wherein recipient has refused to accept the delivery of the order.
